FFOS seek leave to apply for a Judicial Review of the decision to issue CEC 4952/2016

Fishermen and Friends of the Sea (FFOS) have on 29th September 2017, filed an application for Leave for a Judicial Review of the decision by the Environmental Management Authority (EMA) to issue a Certificate of Environmental Clearance (CEC 4952/2016) dated 22nd June 2017, to the Ministry of Works and Transport (MOWT), for the “specific purpose of the establishment of a 5000 meter highway alignment commencing at a point 300 metres east of the Cumuto Main Road and ending at a point 600 metres west of Guaico Trace, Sangre Grande”.
FFOS have submitted, that in our view, the CEC issued by the EMA to the MOWT is “unreasonable, illegal, procedurally improper, irrational, null and void and of no effect.”
FFOS will be respectfully seeking the Honourable High Court to quash this CEC and if granted Leave, will be asking the Court for several things including an interim injunction to halt all expenditure and/or construction works on this Project until the matter is Ruled on.
Hearing begins on Thursday 5th October at 2 pm in the Port of Spain High Court, Room POS 3.
