A Win for Ecological Justice
Date: February 9th 2018
Dear Editor/Newsroom,
It is a wonderful day for ecological justice as we have had a successful day in the court of appeal. FFOS had 2 applications before the court and were successful in both.
The application to have our appeal deemed fit for urgent and early hearing was granted and it is expected that the appeal will be heard in early March.
Our application for an injunction to block any construction work on this 5km Cumoto to Sangre Grande stretch of the highway was also successful as the Court of Appeal granted an injunction prohibiting Kallco, the MOWT and NIDCO from doing any construction works on the highway until our appeal is heard.
The judge rejected an application by Rohan Sininan’s Ministry of Works to continue work on the access road so that they can construct a permanent site office.
In his oral reasons, Justice of Appeal Rajkumar said that FFOS’ case raised serious issues to be tried as there was merit in the arguments. We therefore look forward to arguing our case in the Court of Appeal and commend and are eternally grateful to our legal team comprising Anand Ramlogan SC Jayanti Lutchmedial Robert Mitchell and Ganesh Saroop for their hard work and commitment.
Yours in sustainable and inclusionary development,
Gary Aboud Corporate Secretary – FFOS
